Note in the below that this is a description of the evil that precedes the Antichrist who is the Abomination of Desolation. Our Lord and Saviour Jesus Christ then comes after the reign of Antichrist has proceeded for a while. Antichrist, his reign and the False Prophet and all their followers are then destroyed by the Second Coming of Our Lord Jesus Christ from heaven with all His elect Angels and sent to hell forever. The saints will then reign with Our Lord Jesus Christ at their head on earth forever.

Palestine, which is properly the Holy Land for in it walked God in the flesh, Jesus Christ, and there He allowed Himself to be sacrificed for the salvation of those who profess Him from the heart and with the mouth, is a miniature of all the evil that has come upon the earth and there will the final evil be concentrated in its fullness and rule from there for a short time.

Writing in the second century, St. Hippolytus wrote the following about the evil that will abound before the coming of Antichrist:

The temples of God will be like houses, and there will be overturnings of the churches everywhere. The Scriptures will be despised, and everywhere they will sing the songs of the adversary. Fornications, and adulteries, and perjuries will fill the land; sorceries, and incantations, and divinations will follow after these with all force and zeal. The shepherds will be like wolves; the priests will embrace falsehood; the monks will lust after the things of the world; the rich will assume hardness of heart; the rulers will not help the poor; the powerful will cast off all pity; the judges will remove justice from the just, and, blinded with bribes, they will call in unrighteousness.

This is the end of the eschaton and the beginning of the eternal recreated heavens and the earth and will begin when Our Lord and Saviour Jesus Christ returns from heaven in the same flesh He rose with and ascended into the third heaven with, seated at the right hand of the Father. His return will be with all of His elect angels. He will raise and judge all men in the flesh and then recreate the heavens and the earth, which in that state will last that way for eternity. There will NOT be any sin in the new heavens and earth, so prepare now by confessing the Father and the Son and the Holy Spirit and be baptized as commanded above and shown how to baptize below and live Holy and Godly lives in sincerity and humility and meekness waiting for the Lord when He returns so that we are not like the five foolish virgins but are like the five wise virgins.

Method of Baptism

Chapter 7. Concerning Baptism.

And concerning baptism, baptize this way: Having first said all these things, baptize the one to be baptized into Jesus Christ in "the name of the Father, and of the Son, and of the Holy Spirit," in running water. But if you have no running water, baptize into other water [still water]; and if you cannot do so in cold water, do so in warm. But if you have neither, pour out water three times upon the head onto the one to be baptized saying at that time "in the name of the Father and of the Son and of the Holy Spirit." But before the baptism, if possible, let the baptizer fast, and the baptized, and whoever else can; but you shall order the baptized [when there is time] to fast one or two days before.

Baptism can and should always be performed immediately when there is danger of death of the one to be baptized. For instance, impending martyrdom or possible death causing illness.

As the Word of God Jesus Christ willed to learn in His Incarnation what He already possessed and knew prior to His Incarnation as part of His kenosis (emptying out of Himself and taking upon Himself our nature while in no way losing anything of what He already was as God by nature and Son of God as the Second Person of the undivided Trinity) and as an example to us of how we in humility must follow God the Father and the Son Jesus Christ and the Holy Spirit.

The Muslim feast of Eid only commemorates the typological sacrifice by Abraham of Issac. That prefigured the final and only Supreme Sacrifice of Jesus Christ on His Most Holy Cross. All Muslims and everyone who will, are invited and encouraged to come to the water of life now and be baptized in the water and in the Spirit in name of the Father and the Son and the Holy Spirit and receive Communion.

Two Journalists Detained by Palestinian Security Forces

The Arab Network for Human Rights Information (ANHRI), today, denounced the detention of two journalists by Palestinian security forces, during their coverage of the clashes between residents of Jalazoun and Palestinian security forces, north of Ramallah. 

Palestinian security forces detained, last Sunday January 12, “Samer Nazzal” and “Shady Hatem”, photographers of “Raya Media Network”, while they were covering the security forces’ assault on refugees of Jalazoun camp; following the latter closed all the streets leading to Ramallah, in protest against the neglect of UNRWA -United Nation Relief and Works Agency- to the strike of their workers, which has started since 40 days.
The conditions of services in the camp, consequently, were deteriorated. A number of refugees had been wounded and transferred to the hospitals in order to receive treatment, after security fores dispersed them by batons. Following a short period of time, the photographers were released after the contents of their cameras had been deleted. They were also prevented from continuing their press coverage. Moreover, the photographers were being negotiated on not to ever again shoot assaults on citizens, and to focus, instead, on citizens’ reactions towards the police. They, however, refused to do so.
“Palestinian security forces’ detention of two journalists while they were doing their work is considered a clear violation of press freedoms, and an attempt from authorities to muzzle mouths and the opposition; in the light of violations committed by the authorities against demonstrators in order not to expose such violations to the public opinion. The detention is also considered as a continuation to the violations committed by Palestinian security forces against journalists and media professionals, for example, during their coverage of protests in Al-Bireh city in West Bank; in response to calls by Hamas movement last August”, ANHRI said.
ANHRI added that Palestinian authorities shouldrespect the Palestinian Basic Law, which affirmed, in Article 19, on the freedom of opinion, expression and peaceful protest.
ANHRI demanded from Palestinian authorities to open an immediate investigation into the detention of two journalists, who were prevented from doing their work. It also calls for bringing the security personnel, who are responsible for such a violation, to a fair trial.
IMG_0994It should be noted that the European police unit COPPS has been stationed since years in Ramallah and trains the Palestinian Police in the suppression of the Palestinian civilian society and of any citizen who would express views against the occupation.
The EU COPPS is garrisoned in Ramallah and works in occupied Palestine according to supplemental political protocols imposed on the Palestinian people. Their presence has resulted in a great increase in the brutality of Palestinian police. They are fully responsible for mass arrests, torture, deaths and continued violations of human rights perpetrated by the Palestinian police.
The European COPPS forces train the Palestinian police to do their dirty work which simply can be described as methodical violations of the international humanitarian law, as repressive dictatorship gangs whose tasks are defined simply as suppressing Palestinian opposition to the occupation and to turn Palestine into a bigger Guantanamo.

وأفاد نزال لمركز مدى بأنه كان يقوم بتصوير الأحداث مع زميله شادي حاتم، وأثناء ذلك اقترب منهما رجال الأمن والشرطة وقاموا بمصادرة كاميرتيهما. وأضاف نزال: “بعد حوالي ربع ساعة أعادوا لنا الكاميرات ولكنهم قاموا بحذف الصور وأمرونا بعدم تصوير وجوه رجال الأمن أو تصويرهم وهم يعتدون على أهالي المخيم
إن المركز الفلسطيني للتنمية والحريات الإعلامية مدى يستنكر هذا الانتهاك الذي يتنافى مع القانون الأساس الفلسطيني الذي كفل حرية الرأي والتعبير. ويطالب الجهات المختصة بتمكين الصحفيين من أداء واجبهم المهني بحرية
ووفقا لما ذكره راديو بيت لحم في تقرير نشره على موقعه - قام أفراد من الشرطة الخاصة (شرطة مكافحة الشغب) مساء اليوم الجمعة، بالإعتداء على مصور “شبكة راية الإعلامية” الصحفي شادي حاتم وتمزيق قميصه، بالاضافة إلى مصادرة الكاميرا الخاصة بالزميل منذر زهران وحذف الصور منها بالقوة، وذلك اثناء تغطيتهم لمباراة لكرة الطائرة في ملعب ماجد اسعد برام الله بين فريقي جيوس وسنجل
و حول تفاصيل الحادثه قال الصحفي شادي حاتم” أثناء تغطيتي للمباراه وفور انتهائها وقع شجار بين مشجعي الفريقين مما استدعى تدخل شرطة مكافحة الشغب، لذا ابتعدت عن مكان الشجار نحو احدى الزوايا، لكن على الرغم من ذلك تقدم أحد أفراد الشرطة نحوي و امسكني واقتادني خلفه، وسألني اذا قمت بالتقاط أي صور لما يجري، رغم افصاحي بشكل واضح بأنني أعمل كصحفي، لكنه لم يقتنع بذلك و قام بالاعتداء علي و تمزيق قميصي
من جانبها ادانت إدارة راية أف إم وشبكة راية الإعلامية هذا الإعتداء غير المبرر على مصورها شادي حاتم، و الزميل منذر زهران، وطالبت الشرطة الفلسطينية بالتحقيق بالحادثة وباعادة الاعتبار للزميلين المصورين شادي حاتم ومنذر زهران وتقديم الفاعلين من الشرطة للقصاص الذي يستحقونه وفقا للقانون واجراءات الشرطة في مثل هذه الأحداث.
جدير بالذكر بأن قوات الأمن الفلسطينية تواصل إستخدام القوة المفرطة حيال الصحفيين والمصوريين الذين يقومون بتصوير وتوثيق الجرائم التي ترتكبها أثناء أقتحامها للمخيمات الفلسطينية لإعتقال المواطنين إستجابة لمطالب إسرائيلية, وخلال مواجهتها للمسيرات السلمية
وتستخدم السلطة الفلسطينية نظام القبضة الحديدية للأنظمة الديكتاتورية في مواجهة الشعب الفلسطيني, وهي تتلقى تدريباتها على أيدي قوات الشرطة الأوروبية “كوبس”,  التي تتواطأ بشكل مباشر مع أنتهاكها لحقوق الإنسان وذلك خلافا لنصوص القوانين والدساتير الأوروبية المعمول بها في بلاد الإتحاد ألأوروبي

Protests Lead to Arrest of Journalists and Lawyers

protestTuesday – November, 26 2013 – 35 Egyptian activists were arrested by the Egyptian security forces during a peaceful protest organized by the “No to Military Trials for Civilians” movement outside of theShura Council in Cairo. The protesters were expressing their rejection against an article regulating military trials for civilians in the new constitution. The police used excessive force and tear gas against the peaceful protest, and they arrested dozens of activists who were participating in the protest demo, including  journalists and lawyers.
In a related development, the Kasr Al-Nile Court for Misdemeanours today ordered the imprisonment for one month of activist Ayman Maher. He was fined EGP 50 and a bail of EGP 100 was imposed to suspend the ruling. The security forces arrested Maher during his participation in the second anniversary of the “Mohamed Mahmoud incidents”. He was accused of possessing and distributing the statements of the “Thuwar” front, what is deemed by the regime as incitement to subversion.

Global Campaign to End Violence Against Women Journalists

imagesThe International Federation of Journalists (IFJ) launched a global  campaign to denounce violence against women journalists and alert public authorities on their need to to end impunity for  these crimes. This campaign is a response to the numerous cases of women journalists being threatened, attacked, harassed, raped or even killed in the course of their profession.
“Tragically, women journalists are under bigger threat than their male colleagues when it comes to attacks, bullying, threats, cyber-bullying, rape and abuse; all effective tools to silence women’s voices in the media. As we encourage more and more women into the profession, their safety must be paramount,” said IFJ Gender Council co-chair Mindy Ran.
According to the IFJ, six women journalists were killed this year in the course of their profession. Rebecca Davidson, a New Zealand national, deputy head of programming at the Dubai-based Arabian Radio Network was killed on 8 February  in a boat collision while on assignment in the Seychelles.  Journalist Rahmo Abdulkadir working for Radio Abudwaq was shot in Towfiq district in north Mogadishu, Somalia capital, when she was close to her house. Baiu Lu, from the Urumqi Evening News died on 18  April,  in an accident while conducting interviews on a construction site in Urumqi, capital of Northwest China. Habiba Ahmet Abd Elaziz from UAE-based Xpress newspaper was killed on 14  August together with four other journalists in Egypt. Yarra Abbas, television correspondent for Al-Ikhbariyah TVwas killed on 27  May, while covering clashes near the border with Lebanon. French reporter Ghislaine Dupont, who worked for Radio France International (RFI) was  abducted and shot dead on 2nd November  together with her male colleague Claude Verlon in the Malian northern city of Kidal.

“A one day protest  on 25 November is not enough to fight against attacks against our female colleagues,” said Zuliana Lainez, member of the IFJ Gender Council and the IFJ Executive Committee. “We are launching a Working Party to ensure that constant attention is paid to the safety of our colleagues throughout the world and regular alerts and protests are launched to denounce these crimes. Part of the activities include a twitter action to mark 25 November International Day for the elimination of violence against women,” says Lainez who will lead  the Working Party.
“We urge media organisations to do their best to fight violence against female media workers,” says Mounia Belafia, IFJ Gender Council co-chair. “Respect for gender equality is  an important step for this and media must be made accountable for mainstreaming gender in all their activities.”
The IFJ encourages journalists, their unions and supporters to express their concerns over violence against women journalists and demand an end to impunity for these crimes

Bob Rae, Yasser AbbasA son of Palestinian Authority President Mahmoud Abbas, Yasser Abbas, is appealing a judge’s ruling last month tossing out a libel case against the Washington Post Company’s Foreign Policy magazine.
Yasser Abbas’s attorneys filed a notice Wednesday appealing U.S. District Court Judge Emmet Sullivan’s Sept. 27 decision dismissing the lawsuit under a District of Columbia law that allows for early termination of lawsuits stemming from statements  on matters of public importance.
The suit objected to a commentary Foreign Policy published in June 2012 entitled, “The Brothers Abbas: Are the sons of the Palestinian president growing rich off their father’s system?” The piece was written by the Foundation for the Defense ofDemocracies’ Jonathan Schanzer, who was also named as a defendant in the case.
The appeal will go to the U.S. Court of Appeals for the D.C. Circuit.
A lawyer for the Washington Post Co., Kevin Baine, had no comment on the development. Attorneys for Abbas did not respond to messages seeking comment.

Williams & Connolly Seeks Legal Fees in Libel Suit
Attorneys from Williams & Connolly and Levine Sullivan Koch & Schulz are seeking more than $200,000 in legal fees and costs for their work fighting a libel suit filed in September 2012 against Foreign Policy magazine and a writer.
Yasser Abbas, the son of Palestinian Authority President Mahmoud Abbas, sued Foreign Policy over a June 2012 article written by Jonathan Schanzer, vice president for research at the Foundation for Defense of Democracies. Schanzer was also a defendant. U.S. District Judge Emmet Sullivan dismissed the case on Sept. 30. Abbas intends to take the fight to the U.S. Court of Appeals for the D.C. Circuit.
Williams & Connolly partner Kevin Baine, who focuses on First Amendment work, and associates Adam Tarosky and Elise Baumgarten, are seeking $100,481 in legal fees and costs. Levine Sullivan partner Nathan Siegel, an attorney for Schanzer, is asking for $107,174 in fees. Siegel worked on the case with Levine partner Seth Berlin and associate Shaina Jones. (Schanzer had his owner lawyers; he was not an employee of Foreign Policy.)
Baine said in a declaration, accompanying the Oct. 25 fee request, that Williams & Connolly gave Foreign Policy a 10 percent discount on rates. With the discount, Baine billed at $765 an hour. Baine said he clocked a little more than 25 hours in the case. Tarosky and Baumgarten submitted hourly rates of $409.50 and $342, respectively. (On top of the discount, Williams & Connolly, which employs about 250 lawyers, said the firm further reduced its fees in the case by an average of 12 percent per month.)
Tarosky, a sixth-year associate, and Baumgarten, a third-year associate, worked nearly 234 hours defending Foreign Policy magazine, accourding to Baine’s declaration. At the time the suit was filed, The Washington Post, for whom Baine had previously performed legal work over 30 years, owned Foreign Policy. Baine declined to comment today on the fee request.
Levine Sullivan, a boutique firm with 34 lawyers who specialize in First Amendment and media litigation, charged Schanzer an hourly rate of $390 for work and $195 for paralegals. The firm said in court papers that the rates were “as requested and negotiated by Dr. Schanzer’s insurer.” The rate amounted to a 20 percent discount from $575 rate that Siegel and Berlin typically charge, according to court records in the case. Levine Sullivan lawyers said the firm performed nearly 250 hours of attorney work for Schanzer. Siegel, based in Washington, did not immediately respond to a request for comment.
Baine and Siegel defended their legal fee request in the court filing. The attorneys compared their rates to other Washington lawyers with similar experience in the law. The attorneys pointed to a recent case where U.S. District Judge Richard Leon in Washington awarded attorneys for McKesson Corp. more than $450,000 in fees.
“[T]he rates charged by W&C are materially lower than rates recently approved by courts in this jurisdiction for attorneys of comparable reputation and experience in large law firms. Judge Leon, for example, recently approved rates for attorneys at Winston & Strawn of $780–810 for a senior partner, $525 for a fifth-year associate, and $390 for a first-year associate, all of which exceed the rates charged here.”

US Court Opinion Exposes Abbas Son as a Thief

I. BACKGROUND
A. Yasser Abbas
companyYasser Abbas (“Plaintiff” or “Mr. Abbas”) is the son of Mahmoud Abbas (“M. Abbas”), the President of the Palestinian Authority (the “PA”). Compl. ¶ 9. He owns and operates many businesses throughout the Middle East: he is the chairman of Falcon Holding Group, which owns Falcon Global Telecommunications Services Company, Falcon General Investment Company, and Falcon Electrical Mechanical Company, an engineering company with offices in Gaza, Jordan, Qatar, the United Arab Emirates, and the West Bank that has done work for USAID in the past, Compl. ¶¶ 21, 28; he is the owner of Falcon Tobacco, Compl. ¶ 16; he is the chairman of the publicly traded Al-Mashreq Insurance Company, Compl. ¶ 31; and he is the managing director of the First Option Project Construction Management Company, which has offices in Amman, Tunis, Cairo, Montenegro, and Ramallah and has been awarded USAID funds. Compl. ¶ 32.
Mr. Abbas also serves as a political emissary for his father’s regime, and often travels to other countries and international meetings in this capacity. Anti-SLAPP Mot. at 9-10 (citing Anti-SLAPP Mot., Jones Decl. Ex. 15, 16, 17, 18). He has previously acknowledged that his political involvement in the Palestinian Authority and his business success have engendered controversy. See, e.g. Anti-SLAPP Mot., Jones Decl. Ex. 6, Excerpts from an interview with Yasser Abbas in Ramallah (“Yasser Abbas Interview”), Part 3. Over the last few years, many questions have been raisedabout whether his business success and political ties are linked, though he has systematically denied any such allegations. Anti-SLAPP Mot. at 11-12; see, e.g., Jones Decl., Ex. 24 (Ike Seamans, What do Palestinians Do With Humanitarian Aid Money?, THE MIAMI HERALD, Jan. 25, 2003, at 7B (“Israeli military intelligence charges that Yasser Arafat and his cronies have $20 billion stashed in Swiss bank accounts and invested in foreign real estate. With PA financial help, Yasser Abbas, the prime minister’s son, joined the gravy train. He has gained control of the electronics industry, even though he’s a Canadian citizen who lives in Ramallah only a few months a year.”)); see also Jones Decl., Ex. 21, 22, 25, 26.

As public scrutiny over his business and political activity has increased, Mr. Abbas has used the threat of defamation litigation to counter bad press. Anti-SLAPP Mot. at 14-15. Between 2008 and 2010, Mr. Abbas and his family have filed defamation lawsuits or threatened to sue for libel on three separate occasions against an Israeli television channel, Reuters, and Al-Jazeera. Id. Mr. Abbas has also threatened to sue Richard Falk, the United Nations Special Rapporteur for the Palestinian Territories. Id.
B. Foreign Policy Magazine and Jonathan Schanzer
Foreign Policy is an online and print publication is a “forum for ‘international news and opinions’ covering topics on global politics and economics.” Anti-SLAPP Mot. at 15; Compl. ¶ 5. The magazine contains an “Arguments” section, which is described as: “Polemical, controversial, and powerful, FP arguments provide timely insight on stories making headlines around the world.” Anti-SLAPP Mot. at 16. Foreign Policy also publishes FP Arabic on a bimonthly basis in partnership with the Gulf Strategic Studies Center in Qatar, which contains translated pieces from Foreign Policy and is distributed in the Middle East. Compl. ¶ 7.
Jonathan Schanzer is the Vice President for Research at the Foundation for Defense of Democracies (“FDD”), a non-partisan group that focuses on national security and foreign policy. Anti-SLAPP Mot., Declaration of Jonathan Schanzer (“Schanzer Decl.”) at ¶ 1. Prior to joining FDD, Mr. Schanzer worked as a terrorism finance analyst at the U.S. Department of the Treasury and at several other U.S. think tanks. He has also published two books about Hamas and the Middle East and regularly publishes articles in American and international publications, including Foreign Policy. Schanzer Decl. ¶¶ 2-5. Mr. Schanzer has also testified before Congress twice regarding the issue of corruption in the PA. 2 See Compl. ¶¶ 56-77.
2 Mr. Abbas describes Mr. Schanzer’s Congressional testimony in the Complaint as evidence of malice on the part of Mr. Schanzer. Because the Court finds that contested portions of the Commentary are not defamatory, see infra Section II.C.2, the Court does not reach the question of malice on the part of Defendants.
C. The June 5, 2012 Commentary in Foreign Policy Magazine
On June 5, 2012, an article (the “Commentary”) written by Mr. Schanzer was published in Foreign Policy magazine. Compl. ¶ 10. The article is entitled “The Brothers Abbas: Are the sons of the Palestinian President growing rich off their father’s system?” and appeared in the “Arguments” section of the magazine. It can be accessed by clicking on the “Arguments” link on the FP website. Id.; Defs.’ MTD, Ex. A. In the introduction of the article, Mr. Schanzer writes:
In the wake of the Arab Spring, U.S. leaders have promised to reverse the United States’ long reliance on autocratic, unrepresentative leaders who enrich themselves at the expense of their citizens. There’s only one problem: Just as top American officials have been making these lofty promises, new details are emerging of how close family members of Palestinian leader Mahmoud Abbas, a major U.S. partner in the Middle East, have grown wealthy. Have they enriched themselves at the expense of regular Palestinians – and even U.S. taxpayers?
Defs.’ MTD, Ex. A at 2. Mr. Schanzer then discusses Mr. Abbas, his family, and their business and political interests.3
3 In his Complaint, Mr. Abbas alleged that a number of statements in the Commentary regarding his business interests and political activity were libelous. See Compl. ¶¶ 14, 16, 21, 22, 28, 30, 32, 35, 37, 39, 41. However, in his Opposition, Mr. Abbas considerably narrowed his libel claim and conceded that “the article’s reference to these businesses is not the basis for [his] libel claim.” Opp’n to MTD at 10. In their motion to dismiss, Defendants addressed these statements and argued that they were not defamatory. See Defs.’ MTD at 15-21. Therefore, the Court will treat any allegations of libel relating to these portions of the Commentary in Plaintiff’s complaint as conceded. See Hopkins v. Women’s Div., Gen. Bd. of Global Ministries, 284 F. Supp. 2d 15, 25 (D.D.C. 2003) (“It is well disputed in this Circuit that when a plaintiff files an opposition to a dispositive motion and addresses only certain arguments raised by the defendant, a court may treat those arguments that the plaintiff failed to address as conceded.”) (citing FDIC v. Bender, 127 F.3d 58, 67-68 (D.C. Cir. 1997)).
Mr. Schanzer does not paint Mr. Abbas or his family in a particularly flattering light. He writes of allegations of corruption in the PA and the “conspicuous wealth” of Mr. Abbas and his brother, which Mr. Schanzer claims has “become a source of quiet controversy in Palestinian society since at least 2009.” Defs.’ MTD, Ex. A. He also details allegations made by some in the region against Mr. Abbas and his family, including an allegation by Mohammad Rachid, a former economic advisor to the late PA leader Yasir Arafat who is under investigation for corruption, that President Abbas has “socked away $100 million in ill-gotten gains.” Defs.’ MTD, Ex. A at 2; Compl. ¶ 14.
He also discusses conversations he had with Palestinians during a research trip to Ramallah in 2011, who told him that “the Abbas family dynasty is common knowledge” in the region, but that it was rarely discussed “thanks to growing fear of retribution by PA security officers, who have apprehended journalists and citizens for openly challenging President Abbas’s authority. Defs.’ MTD, Ex. A at 3; Compl. ¶ 37. The online version of the article contains approximately 31 highlighted words or phrases that are hyperlinks to the underlying source material for statements made in the article, which include articles from other publications and company websites. 4 Anti-SLAPP Mot. at 17.

Abbas provided the basis to do so. Foreign Policy also offered Mr. Abbas the opportunity to respond in print. Id. Through his counsel, Mr. Abbas declined and filed this action on September 20, 2012. Id. at 18. On November 5, 2012 defendants filed a motion to dismiss pursuant to Fed. R. Civ. P. 12(b)(6) and a special motion to dismiss pursuant to the District’s Anti-SLAPP Act. The District of Columbia moved for leave to file an amicus curiae brief, which the Court granted. The District filed an amicus brief on December 22, 2012 arguing that the Anti-SLAPP Act is applicable in a federal court sitting in diversity. These motions are now ripe for determination by the Court.
II. Discussion
A. The Anti-SLAPP Act
A SLAPP, or strategic lawsuit against public participation, is a civil action that arises out of a defendant’s communications to government bodies or the public on an issue of public concern. See Brief of Amicus Curiae District of Columbia (“D.C. Amicus Brief”) at 1. The District’s Committee on Public Safety and the Judiciary has noted that SLAPPs “are often without merit, but achieve their filer’s intention of punishing or preventing opposing points of view, resulting in a chilling effect on the exercise of constitutionally protected rights.” Rep. of the D.C. Comm. on Public Safety and the Judiciary on Bill 18-893 (Nov. 19, 2010) (“Comm. Report”)) at 4. By imposing upon defendants the burden of defending against a lawsuit, the Committee concluded that “litigation itself is the plaintiff’s weapon of choice,” Comm. Report at 4, one that was “wielded to chill the speech of those who would otherwise speak out on a matter of public interest,” D.C. Amicus Brief at 1. The Committee also found that the impact of these lawsuits was not limited to defendants against whom a suit had been filed, but also prevented others from voicing concerns regarding issues of public concern. Comm. Report at 4.
To combat this problem, the Council passed the Anti-SLAPP Act in 2010. The protections offered in the Act “follow[] ‘the lead of other jurisdictions, which have similarly extended absolute or qualified immunity to individuals engaged in protected actions’” by enacting similar Anti-SLAPP legislation. Farah, 863 F. Supp. 2d at 36 (quoting Comm. Report at 4). The Act aims to address such concerns “by incorporating substantive rights that allow a defendant to more expeditiously, and more equitably, dispense of a SLAPP.” Id.
To that end, the Anti-SLAPP Act provides in pertinent part:
  • (a) A party may file a special motion to dismiss any claim arising from an act in furtherance of the right of advocacy on issues of public interest within 45 days after service of the claim.
  • (b) If a party filing a special motion to dismiss under this section makes a prima facie showing that the claim at issue arises from an act in furtherance of the right of advocacy on issues of public interest, then the motion shall be granted unless the responding party demonstrates that the claim is likely to succeed on the merits, in which case the motion shall be denied.
D.C. Code § 16-5502(a)-(b). The Act also provides that “[i]f the special motion to dismiss is granted, dismissal shall be with prejudice.” Id. That is, if the defendant meets the burden of showing that the claims at issue arise from the type of activity protected by the Act, the claims must be dismissed with prejudice unless plaintiff can show a likelihood of success on the merits.
The Act applies to claims based on any oral or written statement made:
  • (i) In connection with an issue under consideration or review by a legislative, executive, or judicial body, or any other official proceeding authorized by law; or
  • (ii) In a place open to the public or a public forum in connection with an issue of public interest.
D.C. Code § 16-5502(a)-(b). The Act also provides that “[i]f the special motion to dismiss is granted, dismissal shall be with prejudice.” Id. That is, if the defendant meets the burden of showing that the claims at issue arise from the type of activity protected by the Act, the claims must be dismissed with prejudice unless plaintiff can show a likelihood of success on the merits.
The Act applies to claims based on any oral or written statement made:
  • (i) In connection with an issue under consideration or review by a legislative, executive, or judicial body, or any other official proceeding authorized by law; or
  • (ii) In a place open to the public or a public forum in connection with an issue of public interest.
D.C. Code § 16-5501(1)(A). It applies to “[a]ny other expression or expressive conduct that involves petitioning the government or communicating views to members of the public in connection with an issue of public interest.” Id. An “issue of public interest” is defined as one that is “related to health or safety; environmental, economic, or community well-being; the District government; a public figure; or a good, product, or service in the marketplace.” Pursuant to the Act, an “issue of public interest” “shall not be construed to include private interests, such as statements directed primarily toward protecting the speaker’s commercial interests rather than toward commenting on or sharing information about a matter of public significance.” Id. § 16-5501(3).
In construing the Act, the Court cannot rely on guidance from the D.C. Court of Appeals, which has not yet issued a published opinion interpreting the statute. Where, as here, “the substantive law of the forum state is uncertain or ambiguous, the job of federal courts is carefully to predict how the highest court of the forum state would resolve the uncertainty or ambiguity.” Travelers Ins. Co. v. 633 Third Assocs., 14 F.3d 114, 119 (2d. Cir. 1994). With this in mind, the Court notes that the Committee Report prepared on the Anti-SLAPP Act emphasized that the statute “followed the model set forth in a number of other jurisdictions.” Comm. Report at 1.
The D.C. Court of Appeals has accorded great weight to such reports in interpreting other D.C. statutes. See, e.g. Dist. of Columbia v. Place, 892 A.2d 1008, 1113 (D.C. 2006); Carter v. State Farm Mut. Auto. Ins. Co., 808 A.2d 466, 471 (D.C. 2002). Therefore, where necessary and appropriate, the Court will look to decisions from other jurisdictions (particularly California, which has a well-developed body of case law interpreting a similar California statute) for guidance in predicting how the D.C. Court of appeals would interpret the District’s Anti-SLAPP statute. See Boley, 2013 U.S. Dist. LEXIS 88494 at *8-9.
B. Applicability of the Anti-SLAPP Act in Federal Diversity Actions
The parties dispute whether the District’s Anti-SLAPP Act applies in a federal court sitting in diversity. Defendants contend that because the Act confers substantive protections under the District’s tort law, it is applicable in federal court. Anti-SLAPP Mot. at 21; D.C. Amicus Brief at 5-6. Plaintiff, however, argues that the Anti-SLAPP Act is procedural and thus inapplicable because a federal court must apply federal procedural laws. See Erie R.R. Co. v. Tompkins, 304 U.S. 64 (1938); Anti-SLAPP Opp’n at 3-9.
While the applicability of the Anti-SLAPP Act in a federal court sitting in diversity has not been addressed by the D.C. Israeli Trap to Arrests Palestinian Patient

MIDEAST ISRAEL PALESTINIANSIsraeli forces arrested 14 Palestinians at Beit Hanoun crossing, the so-called “Erez” since the beginning of 2013. The Israeli forces exploit need of Palestinians to travel and use crossings as traps, Al Mezan for human rights reported.
Beit Hanoun crossing crossing, “Erez, מעבר ארז” is located in the far north of the Gaza Strip between the blockade Gaza and Israel. The crossing which is under full Israeli control is dedicated to pedestrians, trucks, diplomats, foreign missions, journalists, workers, Palestinian merchants and other people who have permission to cross into Israel. It is is currently used to transport the Palestinian patients and injured for medical treatment to Jordan, Israel and the West Bank.
According to monitoring and documentation of the Al Mezan Center for Human Rights, since the beginning of 2013 Israeli forces have arrested 14 Palestinians at Erez crossing. Of the 14, three were patients and four were patient escorts. There were also two businessmen arrested.
The Israeli forces continue to use crossings as traps to arrest Palestinians, exploiting the need to travel. Israeli forces make use of its tightened closure of the Gaza Strip to humiliate Palestinians, arrest them, or urge them to collaborate.
Recently, at approximately 7:00 pm on Sunday, September 8, 2013, IOF arrested Mohammed Zaki Al Bakri, 24, at Erez crossing while he was on his way to receive medical treatment at Saint Joseph Hospital in East of Jerusalem.
Mohammed’s mother, who was escorting him, stated to Al Mezan that Mohammed was subject to ill treatment at Erez crossing. Mohammed and his mother went at 11:00 am on Sunday 8 August 2013 to Erez crossing. The Israeli security agency interrogated him and then informed his mother that he was arrested and ordered her to go back to Gaza. While Mohammed’s mother was leaving Erez, she saw Mohammed and his clothes were partially torn up and he sustained bruises and wounds in his neck.

Al Mezan’s lawyer is following Al Bakri’s case. The Israeli authorities informed Al Mezan’s lawyer that Al Bakri’s detention is extended to 16 September 2013 and he is detained at Ashkelon prison.
It’s worth noting that after the continuous closure of Rafah crossing and the Egyptian restrictions imposed on the work of Rafah crossing, Erez crossing becomes the only outlet of Gaza patients whose medicines are not available in Gaza hospitals
The Al Mezan Center for Human Rights expresses its forceful condemnation of the detention of Al Bakri, a medical patient.Al Mezan sees in this incident a continuation of Israel’s policy of extortion of Palestinian patients and exploitation of their medical suffering, in an abuse which makes clear the extent to which Israel exempts itself from its legal commitments under the rules of international humanitarian law (IHL), particularly the Fourth Geneva Convention.
Al Mezan calls on the international community to promptly intervene to stop the Israeli grave and systematic violations of IHL and human rights principles, ensure access to health care of Palestinian patients.
Al Mezan warns of deteriorating in humanitarian situation in Gaza Strip due to the Israeli siege. Al Mezan reiterates its previous calls for lifting the siege and ensuring the Israeli respect of IHL in its dealing with Palestinians.

Farewell of Iranian Ambassador Soltanieh

DSC_5006I was as surprised as honoured to be invited to the farewell reception for Ambassador Ali Asghar Soltanieh, the Representative of the Islamic Republic of Iran to the IAEA and the International Organizations at the UN in Vienna, an invitation which I gladly accepted.
I have known the Ambassador for several years now for his reasoned speeches at the IAEA and the other international organizations at the UN in Vienna. His speeches at the international organizations, the ones which I attended, impressed me as principled yet objective and reasoned, and never varying from a very polite style of presentation. They were always a refreshing contrast of style to the rancorous bombast of the representatives of those delegations which have tried for nearly a decade now, without success, to incriminate his country with imaginary misdeeds.
Dr. Soltanieh should rightly be called a hero of the IAEA, as his personal style as well as his skill as a negotiator may have saved us all from a world war more than once. As a Palestinian, I am grateful for his principled words in support of my people and that he did not shrink from delivering righteous words against the zionists and their allies for their crimes against us.
DSC_5028In his own way, the Ambassador even contributed to the health of the American, Israeli and many delegations of tributary nations with his words, since they’d run for the exit many a time when he took to the podium, and as everybody knows, doing sports is healthy. Personally it was interesting to see how these delegations of many countries which ceaselessly point the finger at others because of human rights abuses, or where the freedom of expression is supposedly held in high esteem, ran for the exit as soon as this one Ambassador would mention truths too ugly for the ears of these puppets. Israel is not an exceptional state and its crimes against humanity are not above criticism and I do not understand why the world scares of Israel while even is not a state but a fraud of a state established in Palestine.

In my memory, Ambassador Soltanieh was the only diplomat who addressed the Palestinian issue with clear words in the muted language of diplomacy but still clear enough to leave no doubts about what was said. With his principled speeches Dr. Soltanieh also exposed the reality about how much free speech is worth in all these western tributaries of Israel. I can testify how true each word of Ambassador Soltanieh about Israel was, because as a Palestinian I know this “state” and its crimes better than most, especially those who hid their heads in the sand leaving their behinds exposed for all to see.
DSC_5021In his own words, Ambassador Soltanieh delivered his shortest speech at his farewell reception. He thanked his guests for attending and said that he was honoured by having been able to work with them, by their attendance as well as by the good relations with the countries they represented and the international organizations. He also stated that his government was determined to continue its policy of maintaining good relations with the international organizations and all countries. His Excellency finally invited his friends to call him in Teheran any time, but to take in account the time difference and not wake him up at night, and invited the attendance to enjoy the traditional Persian foods.
When it became time to say goodbye, I was able to tell Ambassador Soltanieh “The UN and the journalists will miss you”. I am sure that others who saw him working can also say that.
